Deed Restriction Enforcement

​Dear neighbors,


The VEPOA Board has instructed the MASC Austin Properties, Inc. management company to enforce the deed restrictions of the community. Drive-through inspections are performed on a monthly basis and lakeside inspections are performed quarterly. The Board is committed to maintaining our neighborhood in a manner that is both aesthetically pleasing and protective of property values.


If the management company receives a complaint and/or reported violation from a homeowner regarding another home such as a noise nuisance, lighting concern, or other deed restriction violation, a courtesy notice will be sent to the homeowner with the owner making the call left anonymous. It is the responsibility of all homeowners to keep all of these issues well in control; doing so will prevent receiving a deed restriction violation notice and help improve and maintain everyone’s property values.


Enforcement Policy:
We would like to inform you of the enforcement policy for deed restriction violations.


First inspection
A violation notice will be sent to the owner of record and copied to the tenant if the owner is off-site.


Second inspection
A violation notice will be sent to the owner of record and copied to the tenant if the owner is off-site.


Third inspection
A violation notice will be sent to the owner of record and copied to the tenant if the owner is off-site.


Fourth inspection
A certified 209 demand letter will be sent to the owner of record and copied to the tenant if the owner is off-site, providing the owner with necessary action to take with the specified time frame to respond, owner’s rights provisions, and action that can and will be taken if not corrected.


Fifth/Last Chance
A violation notice will be sent to the owner of record and copied to the tenant if the owner is off-site. Any and all of the following actions can and will be taken if the violation(s) are not corrected. Homeowner will have 15 days to correct or to respond to the violations by contacting MASC Austin Properties or submitting a letter in writing addressed to the Board of Directors including all extenuating circumstances and reasons for non-compliance.  If we do not hear from the homeowner and/or the violation(s) are not resolved, we will have no alternative but to:


Self-help- the association can have the violation corrected, billing all costs to the owners account.


Legal action- the association can approve legal action be taken against the owner for enforcement which can lead to a lawsuit being filed against the owner.


Upon inspection of the property, the Board, committee or management can escalate the enforcement of the policy should it be deemed necessary. It is the homeowner’s responsibility to contact MASC Austin Properties, Inc. to update their contact information (new mailing address and contact number). If the owner does not live onsite (and we have their current information) the original deed restriction violation notice goes to their mailing address and a tenant copy is mailed to the onsite address. We encourage you to contact Gloria Rodriguez, Deed Restrictions or Leticia Gomez, Property Manager if you receive a letter, have any concerns or questions regarding the violation, how to correct the violation or need to address the matter with the Board. If you have corrected the deed violation(s), please contact MASC Austin Properties, Inc. so we can note your file accordingly.
